By purchasing a CAL-E BIKE you're agreeing to the Terms & Conditions set forth below. 

Warranty

One Year Limited Warranty Bicycle Components: CAL-E BIKES LLC warrants that all new CAL-E BIKES ("Bikes") and components therein are warranted to the original retail purchaser ("Purchaser") against manufacturing defects in materials. Warranty does not extend to any damage resulting in water related damage or any damage resulting from Purchaser exceeding the weight limit of 250 lbs. The weight limit includes both rider and any gear. Warranty does not extend to any wear and tear. 

One Year Limited Warranty Battery Components: CAL-E BIKES LLC warrants to the original purchaser that the battery is free of defects in material and workmanship for a period of  (1) year from the date of original retail purchase.  Warranty does not extend to any damage resulting in water related damage or any damage resulting from Purchaser exceeding the weight limit of 250 lbs. The weight limit includes both rider and any gear. Warranty does not extend to any wear and tear, including depleting battery capacity. The defective product will be replaced or repaired if met under certain pre-conditions. The original receipt of purchase is required to establish proof of purchase and warranty date and must be provided to CAL-E BIKES LLC for all warranty claims. Shipping costs are an additional charge. The original battery sale receipt must be maintained for any further claims. All replacement batteries will be warranted for the balance of the original warranty period. Replacement will be honored only by CAL-E BIKES, LLC. You are responsible for paying the following costs associated with the replacement; labor for removal or installation; applicable taxes; and any shipping or transportation costs incurred in returning the battery to CAL-E BIKES for evaluation.

Purchaser hereby releases, Indemnifies and holds harmless  CAL E-BIKES LLC and its parent companies, successors, assignees and their respective officers, directors, agents and employees, from and against all claims arising from or related to use by Purchaser or any third party. Purchaser covenants that , at its own expense and at the request of CAL-E BIKES LLC , it will investigate and resolve every such claim made and defend every suit, action or proceeding that may be brought against CAL-E BIKES LLC based on any such claim, including, but not limited to, any suit, action or proceeding brought based on contract, tort or product liability claims. Purchaser agrees to pay all costs, damages, expenses (including attorney's fees), and judgements that CAL-E BIKES LLC may sustain be reason of any such claim, suit, action or proceeding.  CAL-E BIKES LLC shall, within a reasonable period of time, give Purchaser written notice of any such claim, counterclaim, suit, action or proceeding.

Purchaser agrees that this purchase agreement includes all of the terms, conditions and warranties as set forth above and that this Agreement cancels and supersedes any prior agreement and as of the date hereof, comprises the complete and exclusive statement of the terms of the Agreement relating to the subject matters covered hereby. The Purchaser by his/her execution of this Agreement acknowledges that he/she has read its terms, conditions, and warranties hereof. NO RETURNS, REFUNDS, OR EXCHANGES ARE PERMISSIBLE EXCEPT AS NOTED ABOVE.
